Conditions of Participation - Simply Ride!


These Conditions of Participation govern registrations for the Bridgestone Simply Ride! promotion submitted on the website. Customers may register for the promotion at http://www.bridgestone-simplyride.eu.

Clause 1- Definitions

1.1 Promotion: The Bridgestone promotion as described in further detail in Clause 3.

1.2. Promotion period: The campaign starts on 01/06/2019 for an indefinite duration. However, Bridgestone is entitled to terminate the campaign at any time without providing any reasons and may redefine the campaign duration at a later time.

1.3. Participant: A person who participates in the promotion and meets the eligibility criteria set out in Clause 2 of these Conditions of Participation.

1.4. Reward: The participant will receive a 24 months warranty for the Bridgestone tyres registered for the promotion.

1.6. Promotion rules: The promotion's General Terms and Conditions, Data Protection Policy and Cookie Policy apply as disclosed on the promoter's website at http://www.bridgestone-simplyride.eu.

1.7. Reward recipients: Participants who receive the reward in accordance with Clause 3.1. Limited to available stock. The promotion period will end early if the available stock runs out before the official closing date.

Clause 2 - Eligibility criteria

2.1 Purchase and proof of purchase

Customers who have purchased at least 1 new Bridgestone motorcycle tyre from a Biker's Club dealer are eligible to register for the Simply Ride! promotion. Eligible products include Bridgestone motorcycle tyres (scooter, racing, off-road and motocross tyres are excluded) and OEM tyres (all car manufacturers) that are registered within 14 days from the purchase date.

Proof of purchase (invoice, purchase receipt, electronic purchase receipt with the dealer's letterhead or stamp clearly showing the dealer and name and type of Bridgestone summer tyre) must be uploaded to http://www.bridgestone-simplyride.eu when registering for the promotion.

The purchase receipt must clearly show the purchase of at least one Bridgestone motorcycle tyre (scooter, racing, off-road and motocross tyres are excluded) from a Biker's Club dealer within the promotion period. The invoice must be issued in the name of the participant or his/her company. Each purchase receipt entitles to a single registration in the promotion. Multiple registrations will result in deactivation of the initial and all subsequent registrations, which will be deleted at the end of the promotion. Participants who submit multiple registrations will be permanently disqualified from the promotion.

If no valid purchase receipt is submitted within 14 days from registration, or if an invalid purchase receipt is submitted, the participant's account will be deactivated and deleted by Bridgestone after the end of the promotion. These registrations are not eligible to participate in the promotion and excluded from receiving the reward.

2.2 The following persons are eligible to participate in the promotion:

a) all individual persons (private persons, freelancers, physicians or business owners) of at least 18 years of age with permanent residence in Germany, Austria, Switzerland, France, Italy, Netherlands, Belgium, Luxembourg or Spain. 

b) all legal entities with registered office in Germany, Austria, Switzerland, France, Italy, Netherlands, Belgium, Luxembourg or Spain.

2.3 The following persons are excluded from participating:

- Bridgestone employees, 
- participating trade partners
- participating agencies 
- participating service providers 
- participating companies and dealers, including their relatives.

2.4 Prohibition of proxy registrations: Employees of Bridgestone, participating trade partners and participating agencies, service providers and companies, as well as their employees and relatives, are prohibited from submitting entries on behalf of third parties (purchasing consumers) - including on the basis of express instructions from such third parties. Any person found to be in breach of this provision will be permanently disqualified from the promotion.

2.5 Persons found to be cheating or otherwise trying to manipulate the promotion with the aim of gaining an undue advantage will be excluded and permanently disqualified. Rewards/vouchers issued to these persons may be revoked and reclaimed at a later date.

2.6 By registering for the promotion, the participant accepts these Conditions of Participation.

2.8 The promoter reserves the right to exclude participants who submit incomplete or fake addresses or names, and to disqualify registrations from participants who abuse, manipulate, circumvent or attempt to manipulate or circumvent the Conditions of Participation, or who engage in any kind of fraudulent conduct.

2.9 Participants may only submit a single registration for the promotion during the promotion period and are required to register in the manner set out in these Conditions of Participation.

2.10 Registration requires participants to have a computer, smartphone or another type of user device that is connected to the Internet.

2.11 Depending on the participant’s e-mail provider, all e-mail confirmations and messages concerning extensions can be classified as spam. It is the participant’s responsibility to regularly check his/her spam folder.

Clause 3 - Description of the promotion

The Bridgestone Simply Right! promotion starts the .Registrations for the promotion are only accepted within the promotion period. To be eligible to register, customers must purchase certain tyres (as set out in Clause 2) and register their purchase or their vehicle’s OEM tyres (all car manufacturers) on the website.

Clause 4 - Registration, trial phase and feedback

4.1 Participants must initially complete the registration form and complete a double opt-in process to confirm their registration. The information submitted is then verified and the warranty certificate will be prepared.

4.2 If the proof of purchase is invalid, the participant will be informed, his/her online account deactivated and the registration deleted after the end of the promotion.

Clause 5 - Reward: 24 months warranty

5.1 A PDF file containing the warranty certificate will be mailed to the email address provided within 24 hours. The warranty period commences upon receipt of the certificate and expires automatically after 24 months from the issue date.

5.2 The warranty covers all damages to the tyre during the running-in period (24 months from the purchase date) that have been reported to us in writing within two years from the purchase date. Any damage reported after the 24 months period are excluded.

5.3 The warranty does not cover damage caused by usual wear and tear, excessive wear, improper handling or defective vehicle chassis parts. Damages to the motorcycle or its rims, as well as damage resulting from malicious destruction or accident are also not covered by the warranty.

5.4 A confirmed claim entitles the warranty holder to a replacement tyre on the basis of the recommended minimum thread depth - 2 mm for the front wheel and 2 mm for the back wheel. Bridgestone reserves the right supply a similar tyre or issue a credit note for the pro rata amount of the purchase price in relation to the remaining thread depth. 

In Germany, credit notes will be issued by Bridgestone Europe NV/SA Germany, in Austria by Bridgestone Europe NV/SA Austria, in Switzerland by Bridgestone Europe NV/SA, Zaventem, Spreitenbach, in France by Bridgestone Europe NV/SA France, in Italy by Bridgestone Europe NV/SA Italy and in Spain by Bridgestone Europe NV/SA Spain.

The warranty does not apply to motorcycle tyres with a lesser thread depth. Claims are assessed by an authorised local Biker’s Club dealer, or directly by Bridgestone a sales representative.

5.5 Credit notes are issued in the pro rata amount corresponding to the remaining threat depth in relation to the original purchase price. The resulting percentage figure is used to calculate the credit amount. The warranty does not cover installation costs etc. Cash redemption is excluded. The credit note amount will be credited towards the price of a new Bridgestone motorcycle tyre.

5.6 By making the reward available, Bridgestone shall be released from all claims and any liability for consequential damages in relation to the reward or resulting from its use.

5.7 The campaign will continue until it is cancelled. If this happens, no further registrations will be allowed on the website. Bridgestone is authorised to delete all registrations erroneously accepted on the website due to technical problems or for other reasons. Only consumers are eligible for cash payment. 

Bridgestone will not be liable for any resulting disappointment or damages. We reserve the right to extend the promotion period.


5.8 Bridgestone reserves the right to cancel or terminate the promotion at any time without giving prior notice and without stating reasons. The Promoters may exercise this right in particular if the proper implementation of the promotion cannot (or no longer) be guaranteed due to technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons. If the cancellation is caused by the conduct of a particular participant, the promoter may claim compensation of damages from such participant.

5.9 Recourse to the courts is excluded.

Clause 6 - LIABILITY WAIVER

6.1 The Promoter, its employees, contractual partners and other third parties involved in the promotion shall not be liable for any damages caused by the reward (or its presentation and/or use) or participation in the promotion. This does not apply in the case of wilful intent, gross negligence and only in case of injuries to life, limb or health, or in relation to the material contractual obligations incumbent on the promoter.

6.2 The promoter, its employees, contractual partners or other third parties involved in the promotion shall not be liable for lost, late or incorrect participant submissions caused by from events that are beyond the promoter's control, such as malfunctioning software or user devices, networks, Internet connections, etc.

6.3 The promoter does not assume any guarantees and shall not be held liable in relation to the rewards presented to participants (except in cases of wilful intent or gross negligence). The promoter shall not be liable for any potential defects in the reward.

Certain jurisdictions do not allow for the exclusion or limitation of liability under some or all of the circumstances described above. In these jurisdictions, the promoter’s liability is limited to the maximum statutory liability.

All taxes payable by the participant under local or other regulations on the whole or part of the value of the reward shall be borne by the participant and can in no way be claimed from the promoter. 

6.4 Markings - brands, titles, logos: All product names, brands and images used for the promotion and/or depicted on promotional materials are protected brands and models etc. of the respective companies and/or licensor, irrespective of whether they are highlighted in any way or designated by a symbol such as ®, ™ or similar.

Clause 7-DATA PROTECTION STATEMENT

7.1 Data protection information

The promoter will treat all personal data of participants strictly confidential and only collect, store and process such data for the purpose of running the promotion. Personal data will only be disclosed to the promoter’s vicarious agents (service providers, agencies, companies contracted with the shipment of the rewards) involved in this promotion. The data is only disclosed to other third parties with the participant's consent or to the extent permitted under applicable law. The personal data of participants will be disclosed to the promoter for the purpose of running the promotion and, in particular, notifying participants by email and telephone in relation to the promotion. 

Participants may at any time request the promoter to provide them with information about their personal data stored by the promoter and further information about the processing of such personal data. Participants may also request their data to be corrected or deleted, or request the processing of their personal data to be restricted. If a request for the deletion of personal data is made, the concerned data will be deleted after the end of the promotion. To exercise these rights, participants are asked to contact the promoter at the contact details provided in clause 1. The participant also has the right to at any time object with prospective effect against the processing of his/her data for the purposes of the promotion. Participants should be aware that the promoter can no longer provide services to them if they object against the processing of their data for the promotion.  


Participants further have the right to at any time lodge a complaint with a supervisory authority, e.g. the State Data Protection Commissioner for their respective place of residence. Alternatively, participants may exercise their statutory rights by contacting the promoter at https://privacy.bridgestone.eu, or our data protection officer at the details provided at https://privacy.bridgestone.eu/ansprechpartner.


When registering for the promotion, participants may opt to receive further information about the promoter's products and services.


Participants who agree to receive further information give a separate declaration of consent to the inclusion of their registration data in the promoter's newsletter mailing lists. Participants may unsubscribe from the respective newsletter mailing lists at any time without incurring any costs other than transmission costs at standard rates by following the "unsubscribe" instructions provided in each e-mail, or by notifying the promoter of their revocation of consent.


7.2 Limitation of liability

The Promoter shall bear liability in accordance with the statutory provisions for damages arising from injury to life, limb or health as well as in cases of statutory strict liability, for example under the Product Liability Act, that are caused by a negligent or intentional breach of duty by the promoter, or an intentional or negligent breach of duty by a legal representative or vicarious agent of the promoter. With regard to other damages, the Promoter shall only be held liable for damages caused by violation of a material contractual obligation or a grossly negligent or intentional breach of duty, or on the grounds of an intentional or grossly negligent breach of duty by his legal representatives or vicarious agents.

7.3 Facebook Disclaimer

This promotion is not connected to Facebook in any way and is in no way sponsored, supported or organised by Facebook.

7.4 Applicable law

The promotion and these Conditions of Participation are exclusively governed by the law of the Federal Republic of Germany for all participants with permanent residence in Germany; by the law of the federal republic of Austria for participants with permanent residence in Austria; by the law of the Swiss Confederation for participants with permanent residence in Switzerland; by the law of the French Republic for participants with permanent residence in France; either right of the Italian Republic for participants with permanent residence in Italy; by the right of the kingdom of Spain for participants with permanent residence in Spain.

7.5 Severability Clause

In the event a provision of these Conditions of Participation is or becomes fully or partially ineffective, the effectiveness of the remaining provisions stipulated in these Conditions of Participation will remain without prejudice. The ineffective provision shall be deemed replaced by such lawful provision as comes closest to the commercial purpose and objective of the ineffective provision. The same applies analogously in the event of these Conditions of Participation containing a regulatory gap (lacunae).

Clause 8 – MISCALLANEOUS

8.1. The promoter reserves the right to (i) modify or extend the promotion and the closing date at its sole discretion and without giving prior notice; (ii) modify the Conditions of Participation at its sole discretion and without stating reasons, and (iii) cancel/terminate the promotion if necessary due to circumstances outside the promoter’s control.

8.2. All entries will become the property of the promoter upon submission, including all intellectual property rights to the submissions. Participants irrevocably and unconditionally waive any and all moral and other claims vesting in their participation in the promotion and declare that they hold all rights necessary to grant the rights provided for in these Conditions of Participation.

8.3. Any questions or matters not provided for in these Conditions of Participation are at the promoter’s sole discretion.


8.4. In the event a court determines that one or a number of provisions stipulated in these Conditions of Participation (or parts thereof) are ineffective, unlawful or unenforceable, the concerned provision shall be deemed abrogated. This is without prejudice to the legal effectiveness and enforceability of the remaining provisions stipulated in these Conditions of Participation.


8.6. Any dispute relating to the promotion or these rules shall fall within the exclusive responsibility of the courts holding proper jurisdiction (see clause 7.4). The Parties are required to make their best efforts to settle disputes between them amicably before litigating their claims.
